TERMS OF SERVICES & Privacy Policy

Your use of the App is subject to these Terms of Services (these "Terms"). Thank you for reviewing these Terms – we hope you enjoy using the App.

"The App"
“The App” refers to a software application developed by us and all related services ("Services") provided by us.

"You"
For all purposes of these Terms, “You” refers to the user of the App anywhere in the world, except if you belong in any of the following categories: (i) a user of the App in the People's Republic of China; or (ii) a citizen of the People's Republic of China using the App anywhere in the world. If you belong in any of these categories, please refer to the the App – Terms of Service (PRC Users) for the terms that apply to you.

"These Terms"
These Terms govern the relationship between you and us in regard to your use of the App. Before accessing or using the App, including accessing a mobile App and a PC application, you must agree to these Terms, and any other policies available in the App.
BY INSTALLING, USIN BY INSTALLING, USING OR OTHERWISE ACCESSING THE APP, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT INSTALL, USE, OR OTHERWISE ACCESS THE APP. THE USE OF THE APP IS VOID WHERE PROHIBITED.
We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms, and any other policies available in the App at any time by incorporating the amended terms in the App. You will be deemed to have accepted such changes by continuing to use the App. If at any point you do not agree to any portion of the then-current version of these Terms, or any other policies, relating to your use of the App, your license to use the App shall immediately terminate, and you must immediately stop using the App.

"Use of The App"
Subject to your agreement and continuing compliance with these Terms, we grant you a, non-transferable, non-sublicensable, revocable limited license to access and use the App for your own non-commercial purposes. You agree not to use the App for any other purpose.
You must comply with these Terms and any policy available in the App during your use of the App and only use the App as permitted by applicable laws and regulations, wherever you may be when you use the App. For example, you agree that you will not, under any circumstances, use the App to produce, store and make public, any content infringing upon any third party‘s rights to its reputation, portraiture, privacy, design, trademark and any other lawful rights.
Using the App does not give you the ownership of our intellectual property rights in the App. All rights, title and interest in and to the App (including, but not limited to, any program, any future updates, computer code, themes, objects, characters, music, in-side design and artwork, image setting profile information, trademark visual effects, user interfaces, functionality, methods of operation, trademark, titles, moral rights, documentation and so on) are owned by us and our licensors. We reserve all rights, including, but not limited to, all intellectual property rights or other proprietary rights, in connection with the App and the Services. As expressly provided in these Terms, you must accept that you have no rights to our intellectual property, in particular to the use of our trademarks, product names, domain names or any other distinctive brand features.
WE RESERVE THE RIGHT TO DETERMINE WHAT CONDUCT WE DEEM TO BE IN CONFLICT WITH THE SPIRIT OR INTENT OF THE APP AND ALL RELATED SERVICES OR MAKE IMPROPER USE OF THE APP.

Your Content in The App
We do not claim ownership of the content that you process, submit, share or post in the App and you retain ownership of any intellectual property rights that you hold in that content. 

Advertising Content in The App
The App may contain advertising or commercial content. You understand and agree that we are allowed to integrate, display and otherwise communicate advertising or commercial content in the App as some of our Services will be supported by advertising revenue. You further agree that we may use targeted advertising to try to make advertising more interesting and valuable to you.

Suspension and Termination
Although it is our intention for the Services in the App to be available as much as possible, there will be occasions when the Services in the App may be at our sole discretion suspended or terminated, including, but not limited to, for scheduled maintenance or upgrades, for emergency repairs, for our sole business strategy shift. Where reasonably practicable, we will give you notice of any suspension or termination. Notwithstanding the abovementioned, we will under no circumstances be held liable to you for any loss and cost arising from or in connection with the suspension and/or termination of our Services in the App. We recommend that you keep a backup copy of Your Content at all times.

Warranties and Disclaimer
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND NEITHER WE NOR ANY OF OUR EMPLOYEES, MANAGERS, OFFICERS OR AGENTS MAKE ANY REPRESENTATIONS OR WARRANTIES OR UNDERTAKINGS OF ANY KIND WHATSOEVER, EXPLICITLY OR IMPLIED, AS TO, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF SERVICES. TO THE EXTENT PERMITTED BY LAWS AND REGULATIONS, WE EXCLUDE ALL WARRANTIES.

Liability For The App
TO THE EXTENT PERMITTED BY LAWS AND REGULATIONS, WE SHALL IN NO EVENT BE LIABLE TO YOU FOR DAMAGES FOR LOSS OF REVENUES OR PROFITS, LOSS OF GOODWILL OR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SPECIAL DAMAGES IN CONNECTION WITH THE APP AND THE SERVICES, WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE AGGREGATE LIABILITY OF THE APP FOR ALL CLAIMS FOR ANY LOSS, DAMAGE OR INDEMNITY WHATSOEVER RESULTING FROM YOUR USE OF THE APP SHALL IN NO CASE EXCEED THE AMOUNT THAT YOU HAVE PAID TO US FOR YOUR USE OF THE APP TO WHICH THE CLAIM RELATES IN THE 6 MONTHS IMMEDIATELY PRECEDING THE DATE OF THE MOST RECENT CLAIM.

Governing Law and Dispute Resolution
These Terms, including, but not limited to, its conclusion, validity, construction, performance and settlement of the disputes, shall be governed by the law of the Hong Kong Special Administrative Region, without giving effect to the principles of conflict of law. Any dispute arising from, or in connection with the Contract shall be first settled through friendly negotiation between You and us. In the case where no settlement to disputes can be reached through amicable negotiation, the disputes shall then be submitted to Hong Kong International Arbitration Centre under the Hong Kong International Arbitration Centre Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of the arbitration will be Hong Kong. The arbitration proceedings will be conducted in English. The arbitral award is final and binding upon both parties. The arbitration fees shall be borne by the losing one except otherwise awarded by the arbitration commission.

Governing Language
These Terms may be translated in various languages and the English version of these Terms shall prevail and override.

Notices
We may notify you via postings in the App, and via e-mail or any other communications means, based on the contact information you provide to us. 

Special Terms for USA User
If you are a user of the App in the United States of America, the following terms are incorporated into these Terms, and override these Terms to the extent of any inconsistency that occurs:
If you are a California resident, you agree to waive California Civil Code Section 1542, and any similar provision in any other jurisdiction (if you are a resident of such other jurisdiction), which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favour at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."
EACH OF YOU AND US HERETO IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE TRANSACTIONS CONTEMPLATED HEREBY.

We and its affiliates (“us” or “our”) are dedicated to protecting the privacy of our users (“users” or “you”). Information We Collect
To enable us to provide you with and improve our Sites and our Services, We will collect your personal details and user information pursuant to this Policy to the extent permitted by law when and only when you are browsing our Sites or using certain functions and our Services. If you do not provide this information, we may be unable to provide you with our products or our Services.

Device Information
When you use our Services on your mobile device, we will collect information about your device, including its International Mobile Equipment Identity (“IMEI”), Identifier for Advertising (“IDFA”), Identifier for Vendor (“IDFV”), Integrated Circuit Card Identifier (“ICCID”), Media Access Control (“MAC”) address, model and resolution, which will be used by us to calculate the number of devices that use our products and our Services and analyze data on device models and graphics adaptation.

Network Information
When you use our Sites or our Services online, we will collect information about the network you use, including the name of the operator and the type of network, so as to understand the distribution of operators and networks used by our users. In addition, we will collect information such as the name of the WiFi to which you connect and the duration of your WiFi connection to understand the environment in which you prefer to use our Services.

Advertising
We may include advertisements within our Services, and we may collect and use information about you such as your device identifier, MAC address, IMEI and geographic location and IP address for the purpose of tracking these advertisements. We will use this information to create a unique user account to help us better count and track advertisements based on language, geographic location and other details. We will not sell this information to third parties.

Information Collected by Third-Party Services
Our Services provided to you may contain third-party tracking tools from our service providers. These third parties may use Cookies, Application Programming Interfaces (APIs) and Software Development Kits (SDKs) within our Services and collect and analyze user information on our behalf. Third parties may access your information such as your device identifier, MAC address, IMEI, region (defined as the location where a given language is used), location information and IP address for the purpose of implementing our Services provided under their respective privacy policies. This Policy does not govern the use of third-party tracking tools. We have no access to or control over such third parties. Information Collected as Part of User Experience Programs
We may launch a user experience program on our products to improve our products and our Services and improve user experience. You may choose to join and leave such user experience programs at any time. After you have agreed to join a user experience program and before you choose to leave the program, we will collect your information in accordance with the program. This information will be used by us to better understand and improve our technologies and our Services and will not be used to identify you.

Other Information
We may also collect other information which is not related to your identity. For example, we may collect information on the type and version number of your operating system to better understand system upgrades, we may collect information on your system language for the purpose of language adaptation, and we may collect your app list to understand user preferences. If we choose to collect such information, we will do so for the purpose of improving our Services provided to you. In addition, we may use the calculations of the information about the face mapping depth in the interfaces of Apple’s ARKit and TrueDepth to achieve better facial image processing effects, and we will not use these calculations for any other purposes, nor will we capture any data in documents or upload data to the server for recording purposes or for the purpose of collecting your face mapping depth in any other way.

How We Use Information
We collect user information and personal details so that we can provide our products and our Services to you and ensure our compliance with relevant laws. We will use your user information and personal details collected under “The Information We Collect” for the following purposes:
* (i) Services To provide, process, maintain, improve and develop our Sites and/or our Services provided to you, including customer support, and other services provided through our devices or our Sites.
* (ii) Statistical analysis To develop and analyze statistics on the use of our products and our Services for the purpose of improving our products and our Services. 
* (iii) To provide location-based services When you use our Services, we or third-party service providers may take advantage of your location information to provide you with the correct version of our Services and improve your user experience.
* (iv)To improve user experience Certain optional features such as user experience programs allow us to analyze data regarding the use of our products and our Services and improve user experience.
* (v)To provide push services We may use your MTid and device information to provide push services to assess the performance of advertisements and the success of software updates, or provide notifications on new product releases. You may turn off this feature at any time by changing your preferences under “Settings”.
* (vi)To verify your identity Verifying your identity using a text message when you log in to your account helps prevent unauthorized logins to your account. We are required by law to verify your identity once you enable the live video streaming feature.
* (vii)  To collect feedback from you Your feedback is of great value in helping us improve our Services. To keep track of your feedback, we may use the personal details provided by you to contact you and retain the records.
* (viii) Other purposes We will store and maintain information about you for the purpose of running our operations and complying with our legal obligations.

Information Sharing and Disclosure
We will not sell any personal details to third parties. We may share information about you with third parties who provide services on our behalf or assist with our business activities. Such third parties may use your personal details that are required for providing us with the following services only when providing the following services:
* (i) Fulfilling orders and delivering parcels;
* (ii) Processing payments;
* (iii) Providing customer services;
* (iv) Sending marketing messages;
* (v) Providing subscription services;
* (vi) Conducting research and analysis; and
* (vii) Providing cloud computing infrastructures.

* (iv) taking action in line with our purposes as described in the “The Information We Collect” section, provided that the recipient of any such disclosure by us is also bound by this Policy and can provide adequate protection for your information and/or;
* (v) complying with laws and regulations or requests by government departments or judicial authorities, which are typically designed to uphold Internet security and the rights, property and safety of us, our users and third parties.

Information Security
We will take reasonable measures to prevent the loss, improper use of, unauthorized access to or disclosure of information. For example, some of our Services will use encryption techniques (such as SSL) to protect your personal details. However, you understand and accept that (in the Internet industry) even though we will take all possible security measures, we cannot always guarantee that your information is 100% secure. You understand and accept that the system and communication network used by you to access our Services may fail due to factors beyond our control.

Subject to applicable laws and regulations, we will retain your information (including your personal details) pursuant to the “How We Use Information” section or for as long as needed to provide you with our Services. If you wish to withdraw your consent to our collection, use and disclosure of your personal details or wish us to correct, update or delete your personal details, you may send an email to emojiheap@outlook.com. We will process your request within a reasonable period of time after receiving your email or registered mail, and will cease collecting, using and disclosing your personal details thereafter. Please note that if you withdraw your consent or delete your personal details, your use of some of our Services may be influenced.

Information about Children
We will not knowingly collect or request personal details from children under 13 (or any other age stipulated by law applicable to your region). If you are under 13, please do not send your personal details to us, including your name, address, phone number or email address. Governing Law
This Policy is established, comes into force, and shall be enforced and interpreted under the law of the People’s Republic of China (excluding the laws of the Hong Kong Special Administrative Region and the Macao Special Administrative Region). Any disputes arising hereunder shall also be resolved in accordance with the law of this jurisdiction. We do not represent or warrant that this Policy complies with the privacy law of any jurisdiction. Therefore, you shall not interpret this Policy in accordance with such law.

Updates to This Policy
You agree that we may update this Policy according to relevant laws and regulations or based on our business decisions, and you agree to be bound by any revised version of this Policy. Any significant changes to this Policy will be posted on our Websites or notified to you in another way.

If you are a resident of California, every year we will provide you free of charge with an opportunity to obtain a list of third parties to which we have disclosed or with whom we have shared your personal details during the previous year. 知识产权声明
该应用本身自带的所有版本、技术、程序、素材和所有的信息内容(包括但不限于产品功能、用户界面、操作步骤、商标、专利、计算机软件作品)的知识产权均归我们所有,我们对您的软件使用许可在任何情况下均不应视为向您转让知识产权的部分或者全部。您通过该应用下载、使用的任何素材及其他相关信息内容,仅限您个人娱乐、学习、研究或者欣赏使用,未经我们书面同意,不可用于任何商业用途。您利用该应用拍摄或者制作的信息内容中所含有的知识产权归您所有。

您的合法使用
您应对使用该应用所拍摄、制作、发布或者储存的图片和视频等数据信息的真实性、合法性负责。您不得使用该应用制作、储存或发布如下信息内容:
(1) 危害国家及社会安全信息,其表现可能包括但不限于反对宪法所确定的基本原则;危害国家安全,泄露国家机密,颠覆国家政权,破坏国家统一;煽动民族仇恨、民族歧视,破坏民族团结;破坏国家宗教政策,宣扬邪教和封建迷信;散布谣言,扰乱社会秩序,破坏社会稳定;宣扬赌博、暴力、凶杀、恐怖或者教唆犯罪;煽动非法集会、结社、游行、示威、聚众扰乱社会秩序;含有法律、行政法规和国家规定禁止的其他内容。
(2) 淫秽色情信息,其表现可能包括但不限于发布淫秽、色情内容,包括但不限于招嫖、寻找一夜情、性伴侣等内容;发布以色情为目的的情色文字、情色视频、情色图画等内容;长期发布与淫秽、色情内容擦边的或具有性暗示类的内容。
(3) 侵权信息,其表现可能包括但不限于制作、发布、储存侵犯他人名誉权、肖像权、隐私权、知识产权等合法权利的内容。
(4) 不正当竞争信息,其表现可能包括但不限于发布篡改、增减、删除权利标识的内容;发布未经授权方授权的内容等。
(5) 其他违反法律法规、政策以及社会公序良俗或干扰该应用正常运营及侵犯任何第三方合法权益的信息。
如您有上述违法或侵害他人合法权利的行为,我们有权立即采取适当措施,包括但不限于:删除该等违法信息内容,终止对您的软件使用许可并停止所有技术服务,诉诸执法机构或司法机关等。若因您违法或不当使用该应用而造成的自身损失或对我们和/或第三方造成损害的,您须自行承担所有责任。

广告业务许可
该应用中可能包括广告,这属于我们合理合法的商业模式,您同意在使用该应用过程中接收由我们与第三方合作伙伴发布的广告信息。

不可抗力与其他免责事由
该应用在使用中会受到包括但不限于如下不可抗力或者其他因素的影响:政治原因、社会环境、自然灾害、经济危机、计算机病毒或黑客攻击、服务器或系统不稳定、您所在的特殊位置、任何技术能力、网络质量以及通信线路、计算机故障等(以下统称“免责事由”)。若出现上述免责事由情况时,我们将尽努力在第一时间进行修复或者及时补救,给您造成损失的,我们在适用法律与政策允许的范围内免责。

适用法律与政策
与本协议有关的事项,均应适用中华人民共和国(但不含港澳台地区)的法律与政策( “适用法律与政策”)。该等适用法律与政策可能处于动态变化过程中,因此,若因适用法律与政策发生变化,导致您和/或我们在本协议项下的权益有所增减,均不构成本协议的全部或某个条款自然无效或终止可执行性的依据,除非发生变化的该等适用法律与政策属于效力性强制性规定。

法律纠纷管辖
若在您与我们之间出现了与本协议和/或与该应用有关的法律纠纷,只要发生纠纷时本协议适用法律与政策允许将我们所在地作为唯一或其中之一的纠纷管辖地的,则您同意由我们所在地有管辖权的人民法院排他管辖该纠纷。
